These Terms of Service ("Terms") govern your use of the donation processing platform ("Platform") accessible at donations.winthehouse.gop and sites.winthehouse.gop. The Platform is operated by 1772 Strategies LLC ("Operator", "we", "us", or "our"), a technology services company, on behalf of the Committee to Elect House Republicans ("CTEHR"). CTEHR is a political committee registered with the New Hampshire Secretary of State.
By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1. Platform Description
The Platform is a technology service that provides Republican candidates and campaign committees ("Candidates") with tools to accept online political contributions ("Donations") from individual donors ("Donors"). The Platform provides:
- Customizable donation pages
- Integration with Stripe, Inc. ("Stripe") for payment processing
- Donor data collection and reporting tools
- Campaign finance export functionality
2. Relationship of Parties
1772 Strategies LLC is a technology vendor providing platform services. It is not a conduit, intermediary, or political action committee.
- Donations are processed directly by Stripe into the Candidate's own Stripe merchant account. Neither the Operator nor CTEHR receives, holds, transmits, or has access to Donation funds at any time.
- The Candidate is the merchant of record for all Donations processed through their account.
- Neither the Operator nor CTEHR directs, controls, or influences which candidates receive Donations. Donors independently choose which Candidate to support.
- The Operator's sole compensation is a technology service fee (described in Section 5) deducted automatically by Stripe from each transaction.
- CTEHR sponsors the Platform as a service to Republican candidates but does not operate the technology infrastructure or process payments.
3. Candidate Responsibilities
By using the Platform, each Candidate represents and agrees that:
- Campaign Finance Compliance: The Candidate is solely responsible for compliance with all applicable federal, state, and local campaign finance laws, including but not limited to New Hampshire RSA 664, FEC regulations (if applicable), and any other jurisdiction's campaign finance reporting requirements.
- Contribution Limits: The Candidate is responsible for monitoring and enforcing applicable contribution limits. The Platform collects donor information to assist with compliance but does not enforce contribution limits.
- Reporting: The Candidate is solely responsible for filing all required campaign finance reports with the NH Secretary of State Campaign Finance System, the FEC, or any other regulatory body. The Platform provides data export tools to assist with this obligation.
- Prohibited Contributions: The Candidate must not knowingly accept contributions from prohibited sources (foreign nationals, federal government contractors where prohibited, contributions exceeding applicable limits, etc.).
- Truthful Representation: All information provided to the Platform, including committee name, candidate name, district, and contact information, must be truthful and accurate.
- Stripe Account: The Candidate is responsible for maintaining their Stripe account in good standing, including completing identity verification, providing accurate tax information (including EIN), and responding to Stripe's compliance requests.
- Disclaimers: The Candidate is responsible for ensuring all required political advertising disclaimers are present on their donation page and campaign materials, in compliance with NH RSA 664:14 and any other applicable laws.
- Tax Obligations: The Candidate is solely responsible for all tax reporting obligations related to campaign contributions received.
4. Donor Acknowledgments
By making a Donation through the Platform, each Donor acknowledges that:
- The Donation is made directly to the designated Candidate's campaign committee, not to the Operator or CTEHR.
- The Donor's name, mailing address, employer, and occupation will be collected as required by campaign finance law and may be included in public campaign finance filings.
- The Donor is making the contribution from their own funds and is not being reimbursed by any other person or entity.
- The Donor is a U.S. citizen or lawful permanent resident.
- Refund requests should be directed to the Candidate's campaign. The Operator does not control refund processing.
5. Fees
- No setup fees, monthly fees, or contracts. The Platform is free to join.
- A processing fee of 3.4% + $0.30 is deducted from each Donation. This consists of:
- 2.9% + $0.30 — Stripe's standard card processing fee (paid to Stripe)
- 0.5% — Technology service fee (collected by the Operator as a Stripe application fee)
- Donors may optionally choose to cover fees so the full Donation amount reaches the Candidate.
- The Operator reserves the right to modify the technology service fee with 30 days' notice to active Candidates.
6. Eligibility
The Platform is available to:
- Republican candidates for elected office in the State of New Hampshire
- Republican campaign committees registered with the NH Secretary of State
CTEHR and the Operator reserve the right to approve or deny access to the Platform at their sole discretion.
7. Data and Privacy
- Donor information (name, address, email, phone, employer, occupation) is collected for campaign finance compliance purposes and is stored securely.
- Donor data is accessible to the Candidate whose campaign received the Donation and to Platform administrators.
- Payment card information is processed directly by Stripe and is never stored on or transmitted through the Operator's servers.
- The Operator does not sell or share donor data with third parties outside of the Candidate's campaign and required regulatory filings.
- Donor information may be included in public campaign finance reports filed by the Candidate as required by law.
8. Payment Processing
- All payment processing is provided by Stripe, Inc. pursuant to Stripe's own terms of service and privacy policy.
- Each Candidate's Stripe Express account is a separate merchant account. 1772 Strategies LLC is the platform operator under Stripe's Connect program.
- Donations are typically deposited to the Candidate's linked bank account within 2 business days.
- Chargebacks, disputes, and refunds are handled through Stripe. The Operator reserves the right to suspend a Candidate's account if excessive chargebacks occur.
9. Prohibited Uses
The Platform may not be used to:
- Process payments that are not bona fide political contributions
- Solicit or accept contributions that violate campaign finance law
- Engage in fraud, money laundering, or other illegal activity
- Misrepresent the identity of the Candidate or campaign committee
- Process contributions for candidates of other political parties
10. Account Termination
- Candidates may disconnect their Stripe account and stop using the Platform at any time.
- The Operator or CTEHR may suspend or terminate a Candidate's access to the Platform at any time, with or without cause, upon reasonable notice (except in cases of fraud or legal violation, where immediate termination may occur).
- Upon termination, the Candidate's donation data will be available for export for 90 days. After 90 days, the Operator may delete the account and associated data.
11. Limitation of Liability
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. NEITHER THE OPERATOR NOR CTEHR WARRANTS THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE OPERATOR NOR CTEHR SHALL BE LIABLE FOR:
- Any campaign finance violations, penalties, or fines incurred by the Candidate
- Stripe account issues, payment processing failures, or delayed payouts
- Loss of Donations due to chargebacks, fraud, or disputes
- Any indirect, incidental, consequential, or punitive damages
The Operator's total liability shall not exceed the total technology service fees collected from the Candidate in the 12 months preceding the claim.
12. Indemnification
The Candidate agrees to indemnify and hold harmless the Operator, CTEHR, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- The Candidate's violation of campaign finance laws
- The Candidate's breach of these Terms
- The Candidate's misrepresentation of information
- Any third-party claims related to the Candidate's campaign activities
13. Modifications
The Operator reserves the right to modify these Terms at any time. Material changes will be communicated to active Candidates via email at least 30 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the modified Terms.
14. Governing Law
These Terms are governed by the laws of the State of New Hampshire. Any disputes arising from these Terms shall be resolved in the courts of Merrimack County, New Hampshire.
